Law, Interdependence, and Crises Within and Beyond National Borders

International Conference

The Interdisciplinary Center, Hertzeliya

December 19-20, 2010

Although we recognize that the term 'crisis' is in and of itself politically and socially constructed, in this year's conference we would like to explore this notion and discuss the place, role and power of law in times of changes and crises of these sorts.

Among the topics the conference will address are:

• The connections between law and crisis within the nation state and in a globalized interdependent world.
• Is law an appropriate arena for addressing the social ramification of local and global crises and how can law respond to real and imagined notions of crises? 
• To what extent do legal measures relating to crises affect cultural understandings about the world and about the place and role of law? How do they affect power relations?
• Law's role in local and global processes of mobility – of people, capital and knowledge; amidst changes in local and global regulation; in the  relations between capital and labor; health and epidemics; terror and security; environmental degradation and pollution; wealth accumulation by the few and poverty and deprivation of the many.  
• What can we learn from the past about law in times of crises and what are the new challenges we have to face in the present and near future?

Authors from all disciplines (including law, sociology, anthropology, history, political science, geography, psychology and philosophy) are strongly encouraged to submit papers on topics relevant to the above themes. Papers on other themes will also be considered, but due to the limited number of presentations this year we will not be able to accept all submissions.

Proposals should be accompanied by an abstract of no more than 300 words as Word email attachment (include title of paper, name and email address of author/s with the text of the abstract). Organizers of panels should collect abstracts from the panel participants and submit them together with a description of the panel. Graduate students should submit a letter from their thesis supervisor in support of the proposal, together with the abstract.

המשפט בעידן של משברים פנים מדינתיים וחוצי גבולות

בעשור האחרון, תוך כדי תהליכי גלובליזציה מואצים, אנו נדרשים להתמודד עם אתגרים חדשים ודחופים. תחושות של משבר – התמוטטות שווקים פיננסיים, התפשטות מחלות ומגפות, התחממות גלובלית ואסונות טבע אחרים – חדרו לתודעתנו והעלו את המודעות להשפעה  והתלות ההדדית שבין בני אדם, אומות ומדינות. לאירועים שמתרחשים במקום אחד בעולם עשויים להיות השלכות כלל עולמיות. מובנם של מושגים רבים, כגון  "מדינה" ו"מדינת לאום", "כלכלה", "משפחה", "מיעוטים", "סביבה", "רווחה" וכיוב' מתערער או שמשמעותם משתנה לאור הפרספקטיבה הגלובלית החדשה. בנוסף, תחושות המשבר הובילו להטלת ספק בדבר הלגיטימיות של המוסדות הפוליטיים, הן המקומיים והן הבינלאומיים, ובדבר יכולת המשילות שלהם.

למרות שאנו מודעים לכך כי המושג 'משבר' הוא בעצמו תוצר של הבניה חברתית–פוליטית, אנו מייחדים את הכנס השנתי של האגודה לחשיבה אודות משברים ולדיון בדבר מקומו, תפקידו וכוחו של המשפט בתקופות של שינוי ומשבר.

בין היתר, נרצה להעלות לדיון את הסוגיות הבאות:

טיבם של הקשרים שבין משפט לבין משברים פנים מדינתיים ומשברים חוצי גבולות.

האם המשפט הוא זירה מתאימה להתמודדות עם ההשלכות החברתיות של משברים מקומיים וגלובליים, וכיצד יכול המשפט לתת מענה לתחושות, אמיתיות או מדומיינות, של משבר?

כיצד משפיעים האמצעים משפטיים הנקשרים במשבר על הבנות תרבותיות אודות העולם ובדבר מקומו ותפקידו של המשפט? כיצד הם משפיעים על  יחסי כוח?

מקומו של המשפט בתהליכים המקומיים והגלובליים של ניידות – של אנשים, הון וידע; בשינוי בתוכנה וסוגה של ההסדרה (רגולציה) הן ברמה המקומית ובן ברמה הגלובלית; במערך היחסים שבין הון ועבודה; בריאות ומגפות; טרור וביטחון; זיהום והכחדה סביבתית; הצבר הון על ידי מעטים ועוני ומחסור כמנת חלקם של הרבים.

מה ניתן ללמוד מניסיון העבר אודות המשפט בתקופות של משבר, ומהם האתגרים החדשים שאנו ניצבים בפניהם בהווה ובעתיד הקרוב?

חוקרים מכל הדיסציפלינות (כולל משפטים, סוציולוגיה, אנתרופולוגיה, היסטוריה, פסיכולוגיה, מדעי המדינה, גיאוגרפיה ופילוסופיה) מוזמנים להגיש הצעות להצגת מחקרים בנושאים הקשורים לתימה של הכנס. עם זאת, הצעות האחרות הקשרות לתחום של משפט וחברה במובנו הרחב יבחנו גם הן, ככל שהדבר יתאפשר.

הצעות תוגשנה בליווי תקציר של לא יותר מ- 300 מילים שישלח כצרופה להודעת דואל (המסמך יכלול את כותרת המאמר, שם המחבר/ת, כתובת הדואל ותקציר של ההצעה). מגישי הצעות לפאנלים יאספו את התקצירים מהמשתתפים בפאנל וישלחו את כל ההצעות במקובץ בצירוף תיאור של הפאנל. סטודנטים לתארים מתקדמים יוכלו להגיש הצעות בצירוף אישור מן המנחה שלהם בעבודת המחקר.

Attached to this note are the new ILSA bylaws adopted in the meeting held in Tel Aviv on December 20-21st. The bylaws are based on a draft prepared by Dr. Amnon Reichman from Haifa University and Dr. Michal Tamir from Shaarei Mishpat College of Law.
